Šume

Postoje različiti načini razvrstavanja šuma s obzirom na način na koji se one koriste, razine vlasti s kojih se njima gospodari te s obzirom na različite propise. Propisi o gospodarenju u pravilu definiraju korisnička prava, proizvodna prava, prava iskorištavanja, prava lova i sakupljanja itd. U širem smislu, razvrstavanjem šuma mogu se obuhvatiti i neka druga područja za gospodarenje prirodnim dobrima, poput močvara, livada, zapuštenih te otvorenih područja.

engl. Forests - There are typically many different forest classifications, designated for different uses, management authority levels and with various effective bi-laws. Management regulations typically outline user rights, production rights, extraction rights, hunting and gathering rights etc. Community forests and community land care groups use and manage designated areas by an identifiable community, but in many cases they must gain governmental approval of their management plan. In a more general sense, forest classifications can extend to a wide range of natural resource management areas including wetlands, grasslands, desserts, and cleared areas.

Šumska zemljišta

Šumska zemljišta i sustavi za očuvanje šumskog zemljišta su organizacije koje koriste i upravljaju šumskim područjima. U mnogim slučajevima za to je potrebna suglasnost vlade koja se dobiva kroz prihvaćanje njihovog plana gospodarenja.

Sustav interesa na zemljištu

Interesi na zemljištu se odnose na propisane režime u kojima su prava na zemljištu isključivo dodijeljena fizičkoj ili pravnoj osobi koja "drži" zemljište. Sustav interesa na zemljištu uključuje propise o dodjeli zemljišta i osiguranja prava na njemu, prometu nekretnina, gospodarenju i rješavanju sporova o pravima i granicama protezanja prava.

engl. Land tenure system - Land tenure refers to the legal regime in which rights in land are exclusively assigned to an individual or entity, who is said to "hold" the land. A land tenure system refers to the regulation for the allocation and security of rights in land, transactions of property, the management and adjudication of disputes regarding rights and property boundaries.

Sustavni upis

Proces upisa prava na svim česticama nekog područja, uključujući pritom izmjeru, uknjižbu i sam upis.

engl. Systematic registration - The registration of rights over contiguous parcels on an area-by-area basis, involving adjudication, surveying, and registration.

Teret

Pravo koje nepovoljno utječe na zemljište. Mnoga se mogu upisati u službene upisnike, poput ograničenja iz ugovora, služnosti, hipoteka, zakupa itd.

engl. Encumbrance - A right that adversely affects the land. Many are registerable in formal real estate registration systems; such as restrictive covenants, easements, mortgages and registered leases.

Tipologija interesa na zemljištu

Tipologija interesa na zemljištu za određenu zemlju utvrđena je tijekom provedbe LGAF-a. Ona razlikuje javno i privatno vlasništvo/korištenje te interese na zemljištu od strane autohtonih i neautohtonih zajednica.

engl. Typology of tenure situations - A country-specific typology of land tenure is established during the implementation of the LGAF. It distinguishes Public ownership/use, Private ownership/use and Indigenous and non-indigenous community tenure.

Troškovi prijenosa

Troškovi provođenja upisa prava na zemljištu koje se ostvaruje temeljem neke isprave. Npr. kupovina zemljišta može uz plaćanje cijene zemljišta uključivati i naknade za prijenos zemljišta kroz koje se utvrđuje tko je zakoniti vlasnik, izmjeru i troškove procjene zemljišta, troškove obrade kredita te izrade zakonite dokumentacije potrebne za prijenos. Porezi i pristojbe ne ulaze u troškove prijenosa.

engl. Transaction cost - Costs associated with an agreement over property rights and the costs of enforcing those rights. For example, purchase of land may require not only payment of the negotiation asking price but also legal land transfer fees to establish who is the rightful owner, survey and valuation costs, arrangement of credit and drafting the legal transfer document. Taxes and duties are not considered part of a transaction cost.

Upisan

Za potrebe LGAF-a, pojam "upisan" podrazumijeva nedvosmislen upis podatka o pravima na zemljištu kroz sustav upravljanja zemljištem pri čemu taj podatak u pravilu nije sporan. Pojam "upisan" ne mora nužno značiti da je izdana konačna isprava ili naslov.

engl. Registered - In applying the LGAF, the term „registered‟ means that the rights are recorded unambiguously in the land administration system and there are generally few disputes over the recorded information. The term „registered‟ does not necessarily mean that the final certificate or title has been issued.

Upisnici zemljišta

Pojam "upisnici zemljišta" odnosi se na institucije u kojima se održavaju podaci o upisanim pravima na zemljištu. Podaci o upisanom zemljištu se u pravilu dijele na opisne i prostorne, pri čemu se ovi prvi održavaju u zemljišnoknjižnim, a drugi u katastarskim uredima. U nekim zemljama postoji institucija koja održava oba skupa podataka, dok se pak u drugim zemljama skupni podaci vode samo u katastarskim uredima (npr. pojedine države na Balkanu). U ostalim zemljama su zemljišnoknjižni i katastarski uredi odvojeni. Za potrebe LGAF-a, osim ako nije drugačije navedeno, pojam "upisnici zemljišta" će se odnositi i na Zemljišnu knjigu i na Katastar nekretnina.

engl. Registry - The term „registry‟ or „register‟ is used to denote the organization where the information on registered land rights is held. Information on registered land is typically textual and spatial, with the former typically maintained in a registry and the later in a cadastre office. In some countries there is a combined organization that has both sets of data and in some countries this office is called the cadastral office (in the Balkans, for example). In others there are separate registry and cadastre offices. For the purpose of the LGAF, unless clearly specified otherwise, we use the term „registry‟ to cover both the registry and the cadastre (if one exists).
